1. Scope and Definitions

The following General Terms and Conditions in their version valid at the time of the respective order apply exclusively to the business relationships between Interdependence GmbH, Goethestr. 3, 71686 Remseck (hereinafter "Interdependence GmbH") and the customer (hereinafter "Customer"). Any conflicting or other general terms and conditions and/or other conditions of the customer are expressly rejected, regardless of their designation, unless the seller expressly agrees to their validity in writing.

2. Website

The websites of Interdependence GmbH merely represent a sales brochure. By displaying the products on the websites, Interdependence GmbH is only inviting the customer to submit offers (orders). The order confirmation then sent by email does not yet lead to a purchase contract. Minor color deviations of the goods shown on the website are technically conditioned.

3. Order Process on the Website

3.1 The customer can select products from the seller's assortment and collect them in a so-called shopping cart using the "add to cart" button. If the customer clicks on the "Order with obligation to pay" button, he submits a binding offer to purchase the goods in the shopping cart ("Contract offer").

3.2 Before submitting the contract offer, the customer can view and, if necessary, change the order data via the "Checkout" step.

3.3 After submitting the contract offer, the customer receives an automatically generated confirmation of receipt by email, which once again reproduces the content of the customer's order ("Contract offer") and which the customer can print out. The automatic confirmation of receipt does not yet constitute acceptance of the offer, but merely documents that the order has been received by Interdependence GmbH.

3.4 The purchase contract is only concluded upon the dispatch of the goods by Interdependence GmbH, which then constitutes the acceptance of the declaration on its part. In particular, Interdependence GmbH reserves the right not to accept the offer if an item is not available or if the customer has unjustifiably not paid invoices for previous deliveries. If Interdependence GmbH does not execute an online order, Interdependence GmbH will inform the customer of this immediately.

3.5 Goods are only supplied in customary commercial quantities.

3.6 Interdependence GmbH does not accept orders from customers who have not yet reached the age of 18.

4. Registration for a Customer Account

4.1 To facilitate the use of the Interdependence GmbH online shop, Interdependence GmbH offers the customer the option to create a customer account. In this case, the customer does not have to re-enter his data with every order, but rather it is stored in the Interdependence GmbH customer database and automatically inserted into a new order. When entering his personal data required for registration, the customer is responsible for providing truthful and complete information. The customer undertakes to treat the personal access data confidentially and not to make it accessible to unauthorized third parties.

4.2 Interdependence GmbH requires the following information for registration as a customer: first name, last name, address, country, a possibly different delivery address as well as an email address and the date of birth. The customer enters this data into an input mask. It is stored in the Interdependence GmbH customer database. Interdependence GmbH only uses the stored data in compliance with the applicable data protection regulations. Details can be found in the data protection declaration, which can be viewed at any time in the online shop under the "Data protection" section.

4.3 The customer must refrain from any disturbance of the websites or further use of the accessible data outside of the use intended within the platform. Manipulations with the aim of obtaining unauthorized payments or other advantages to the detriment of Interdependence GmbH or other members lead in particular to the loss of access.

4.4 Each customer is only entitled to maintain one customer account at a time. Interdependence GmbH reserves the right to delete multiple registrations and to warn or terminate members who violate these membership provisions mentioned under point 1 to 6 or to delete or change content (virtual house right).

4.5 A membership is free of charge and can be terminated at any time. You can terminate by sending an informal termination by email to service@hotelshop.one.

4.6 Interdependence GmbH is not obliged to accept the registration as a member or the order of a member. Interdependence GmbH is not obliged to keep its offer permanently available.

5. Prices, Shipping Costs and Shipping Method

5.1 The prices stated at the time of the order apply. All prices stated on the websites of Interdependence GmbH are shown in Euro ("EUR") and include the respectively valid statutory value added tax.

5.2 The customer pays shipping costs per order, which vary depending on the item ordered. The shipping costs are displayed directly on the item. The Interdependence GmbH online shop informs the customer by email about both the receipt of the order (order confirmation) and the successful processing of the order (shipping confirmation).

5.3 Returns are international at the customer's expense. Parcel returns from Germany are at the expense of HOTELSHOP.one. Further information can be found in section "6. Return costs upon withdrawal"

5.4 The goods are shipped via the logistics service providers DHL, DPD, Hermes or UPS. For package sizes that cannot be processed by the above shipping service providers, a forwarding agent will take over the delivery.

6. RETURN COSTS UPON WITHDRAWAL

6.1 If the customer declares his withdrawal, the following return costs apply:

Parcel shipping

Zone 1 - Germany
The return shipping is free of charge. For the return, the customer receives a DHL label with which the package can be sent back to Interdependence GmbH free of charge.

Zone 2 - Austria
The customer bears the costs for the return shipping.

Forwarding agent shipping

Zone 1 - Germany
The collection of the goods at the curb by a forwarding agent is free of charge.

Zone 2 - Austria
The collection of the goods by a forwarding agent at the curb will be charged to the customer with 99.00 Euros.

6.2 Packaging of the Return

We recommend returning the goods, where possible, in their original packaging, as this is best suited for safe return transport. For this reason, we recommend keeping the original packaging until the withdrawal period has expired. Interdependence GmbH does not provide any additional packaging material or new cardboard boxes for returns. The customer is responsible for packing the goods themselves adequately and safely for transport. In the event of a loss in value due to inadequate packaging of the return, Interdependence GmbH reserves the right to demand appropriate compensation.

7. Payment, Default of Payment and Credit Check

7.1 Interdependence GmbH generally offers the payment methods PayPal, credit card (Master Card, Visa, Dinersclub and American Express), prepayment, purchase on account and installment purchase (via Klarna) as well as via Google Pay.

Payment via PayPal
When paying via PayPal, the debiting takes place directly.

Payment on account
The purchase on account is handled with Klarna. For purchases on account, the invoice amount is due within 14 days after receipt of the goods and is to be paid to Klarna. In the event of a previous return of goods, the invoice amount can be reduced accordingly.

Payment by credit card
At Interdependence GmbH you can pay securely and conveniently with the credit cards Visa and Master Card, Dinersclub and American Express. Your credit card data is transmitted encrypted using the SSL process. This security certificate makes shopping with credit cards on Interdependence GmbH secure.

Payment in advance
When paying in advance, the customer is informed after the purchase is completed via the order confirmation to which account the invoice amount must be transferred. After receipt of the invoice amount by Interdependence GmbH, the goods will be sent to the customer.

Installment purchase
If you have decided on the flexible installment purchase with Klarna, you can pay your invoice at your own pace. All orders for which you have chosen flexible installment purchase are collected on a monthly statement. This is always sent in the middle of the month. If you use the installment purchase payment method for the first time, Klarna will send you the first statement in the following month.

Payment with Google Pay
The simple and quick way to pay. Simply pay with what you have anyway - Android smartphone or smartwatch. Faster than reaching for your wallet or paying with a debit card. Your data remains safe and protected.

7.2 Interdependence GmbH reserves the right to exclude payment methods in individual cases.

7.3 In the event of insufficient creditworthiness or creditworthiness, Interdependence GmbH is also entitled to withdraw from all existing contracts in whole or in part in which the customer has not yet paid the purchase price despite due date and reminder. In addition, Interdependence GmbH is entitled to demand immediate payment for goods delivered or prepayment for goods yet to be delivered.

7.4 The customer is in default of payment if he has not paid within 14 days of receiving the goods. An additional grace period is not required. Should the customer be in default with the payment, Interdependence GmbH reserves the right to demand a flat dunning fee of Euro 4.00 € for each reminder. The customer is free to prove that Interdependence GmbH has incurred no damage from the respective reminder or that the damage is significantly lower than the flat dunning fee. At the same time, Interdependence GmbH reserves the right to prove that a higher damage has been incurred by the processing of the respective reminder. In addition, Interdependence GmbH is entitled to demand default interest at the legally permissible rate and, if applicable, additionally incurred processing costs. The customer undertakes, in the event of default of payment, to reimburse all costs, fees and cash expenses that Interdependence GmbH incurs by pursuing its claims.

The costs of debt collection include, in addition to the costs of a judicial procedure, all out-of-court costs, such as the costs of a licensed collection agency and a commissioned lawyer.

8. Retention of Title

8.1 The goods remain the property of Interdependence GmbH until the purchase price has been paid in full.

8.2 In the event of a seizure of the goods or other interventions by a third party, the customer is obliged to inform Interdependence GmbH immediately in writing and to point out Interdependence GmbH's reserved ownership to the third party.

9. Availability and Delivery Times

9.1 If no copies of the product selected by the customer are available at the time of the customer's order, Interdependence GmbH will inform the customer of this separately.

9.2 Delivery is made as long as stocks last. A contract for unavailable goods is not concluded.

9.3 All orders received daily up to 12:00 a.m. will be processed on the following working day. The delivery time is already communicated to the customer on the item detail page before the order is completed. The period for delivery begins with payment in advance / bank transfer on the day after the payment order has been issued to the transferring credit institution and with other payment methods on the day after the contract is concluded. It ends with the expiry of the last day of the period. If the last day of the period falls on a Saturday, Sunday or a public holiday recognized by law at the place of delivery, the next working day takes the place of such a day. The Interdependence GmbH online shop informs the customer about the delivery status in good time.

9.4 All information on the availability, shipping and delivery of a product are only prospective information and approximate guidelines. They do not represent binding or guaranteed shipping or delivery dates.

9.5 Unless otherwise agreed, delivery will be made to the delivery address specified by the customer. A delivery only takes place within the following countries: Germany, Austria.

10. Warranty

10.1 The warranty for defects of the purchased goods is based on the statutory provisions. In particular, the customer can demand subsequent performance (new delivery or rectification of defects). However, Interdependence GmbH is entitled to refer the customer to new delivery if the rectification of defects would involve disproportionate effort. The warranty claims expire 2 years after delivery of the goods.

10.2 Commercial or technically unavoidable, material-related deviations in the quality, color, size, equipment or design of the goods are irrelevant. A right of withdrawal does not exist for such or other insignificant defects. The customer is free to prove that the mentioned deviations are significant for him.

10.3 The customer's warranty claims do not exist if he has changed the goods and the defect was caused by this. The customer's claims for damages or reimbursement of futile expenses only exist in accordance with these General Terms and Conditions.

10.4 Interdependence GmbH is not liable for improper use or natural wear and tear. There is also no guarantee for unlimited durability.

11. Liability

11.1 Interdependence GmbH is liable without limitation for intent and gross negligence. For simple negligence, Interdependence GmbH is only liable in the event of injury to life, body, health or a material contractual obligation. Material contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract and on whose fulfillment the customer has relied and could have relied.

11.2 In the event of a slightly negligent breach of material contractual obligations, the liability of Interdependence GmbH is limited in amount to the foreseeable typical damage.

11.3 The above limitations of liability also apply in favor of the legal representatives and vicarious agents of Interdependence GmbH.

11.4 Liability under the Product Liability Act remains unaffected.

11.5 If Interdependence GmbH refers to links to other sites, Interdependence GmbH is not responsible and is not liable for the content of these sites. Interdependence GmbH has no influence on the design and content of these sites.

12. Free Exchange Right

12.1 A direct exchange is not possible. The replacement item must be ordered again via the online shop.

12.2 In this case, the customer may only use the delivered goods for the purpose of checking - as would be customary for a fitting in a shop - and must return them with the original label at his own expense. In the event of a deterioration of the goods, e.g. due to further use, Interdependence GmbH reserves the right to demand compensation from the customer.

13. Statutory Right of Withdrawal

You have the right to withdraw from this contract within 30 days without giving any reason.

The withdrawal period is 30 days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. The period begins at the time of delivery (day and time) and ends upon expiry of 30 days at exactly that time. Example: If you receive your delivery on 20 May at 3:00 p.m., the return period ends on 19 June at 3:00 p.m.. To exercise your right of withdrawal, you must inform us

by means of a clear declaration (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You can use the attached sample withdrawal form, which is not mandatory.  You can also exercise your right of withdrawal online via our electronic withdrawal function "Withdraw from contract", which is permanently available in the footer of our online shop. If you use this online function, we will immediately send you a confirmation of receipt of your withdrawal declaration on a durable medium (e.g. by email), which also documents its content as well as the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we must repay all payments we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), without delay and at the latest within 14 days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; in no case will you be charged fees for this repayment.

We can refuse the repayment until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is the earlier date.

You must send the goods back to the return address communicated by us without delay and in any case at the latest within 14 days from the day on which you inform us of the withdrawal from this contract. You will find this address depending on the product after registering your return in the Returns Portal.

In Germany, we bear the direct costs of the return for parcels. The return of forwarding goods from Germany is also free of charge. Internationally, you bear the costs of the return. These amount to a maximum of EUR 199.00.

You only have to pay for any loss in value of the goods if this loss in value is due to a handling of them that is not necessary for checking the quality, properties and functioning of the goods.

According to § 312g para. 2 no. 1 BGB, the right of withdrawal does not apply to contracts for the delivery of goods that have been manufactured according to customer specifications or are clearly tailored to personal needs.
